This isn't genuine financial freedom: it's simply a more sophisticated form of "show me your papers". It doesn't do away with the original sin of the 1970 BSA, which is to compromise privacy in the name of security. We have seen what a slippery slope that is, with how the BSA's scope has radically grown over the last 50 years. I would argue the solution is in returning to targeted, warrant-based investigations supported by technology, such as analyzing public blockchain data (like deposits and withdrawals to/from Tornado Cash), to unmask bad actors. Yes, law enforcement could still unmask innocent people using these kinds of techniques, but at least it does so with data that the end user voluntarily released to the world, and does so without any laws forbidding the end user from using any privacy tool. This kind of strategy can be implemented in conjunction with a massive increase in funding for law enforcement agencies. No matter what kind of funding increase is provided, it will be far less expensive than the hundreds of billions of dollars banks — and indirectly the public through higher banking fees — spend every year on compliance with the totally unworkable "presumed guilty until proven innocent" AML regime. So to sum up: I submit that rather than criminalizing privacy, we invest far more resources in focused investigations that respect individual rights. Reforming laws that violate privacy and free association rights so that the violation is more subtle is still a net improvement, but is not going far enough.
