Do Kwon Found Liable for Massive Terra Luna Fraud | Court Verdict

Do Kwon walked into a New York courtroom Tuesday wearing a yellow prison jumpsuit and did something he’d avoided for years. He admitted guilt. The Terraform Labs boss pleaded guilty to two fraud charges connected to one of crypto’s biggest disasters.

Back in 2022, Kwon’s TerraUSD and Luna tokens crashed spectacularly. More than $40 billion vanished overnight. Investors lost everything. The collapse sent shockwaves through the entire cryptocurrency market.

For months, Kwon had insisted everything was legitimate. He told investors that TerraUSD stayed stable at $1 through sophisticated computer algorithms called Terra Protocol. He claimed it was a completely automated system with no need for human involvement.

That was a lie. Prosecutors say Kwon secretly paid millions to trading firms, telling them to buy up his tokens whenever the price fell. He was manually propping up the system while pretending it ran itself. When investors bought in based on these false promises, both TerraUSD and Luna’s values artificially inflated.

Then reality hit. Both currencies collapsed in spectacular fashion.

Kwon didn’t stick around to face the music. When South Korean authorities issued an arrest warrant in 2023, he fled. He ended up hiding in Montenegro before getting caught and shipped to the US.

The original charges could have landed him 135 years behind bars. His plea deal caps prosecutors’ recommended sentence at 12 years, though the judge can still impose up to 25. He owes $19.3 million in forfeitures, and he must also pay restitution to the victims.

Conclusion

Kwon is set to be sentenced on December 11th, but that’s not the end of his legal problems. South Korea still wants him to face additional charges there.
