Healthcare Firm To Hand Out up to $5,000 per Person To Settle Lawsuit Over Data Breach Incident That Exposed Sensitive Personal Information
A firm focused on health is planning to appease a lawsuit by handing out $5,000 per victim over a breach incident that exposed client data.
According to new court documents regarding the Morris Hospital data breach incident show that the healthcare firm has agreed to settle with claimants.
“The Lawsuit claims that Defendant was responsible for failing to prevent the Data Incident and asserts claims such as: negligence, negligence per se, breach of fiduciary duty, breach of implied contract, unjust enrichment, and violations of the Illinois Consumer Fraud and Deceptive Business Practices Act. The Lawsuit seeks, among other things, payment for persons who were injured by the Data Incident.”
In total, Morris Hospital has agreed to pay out $1.36 million to settle the class action lawsuit, up to $5,000 per person.
“Defendant will create a Settlement Fund of $1,361,571.77, which will be used to pay for (i) reasonable Notice and Claims Administration Costs incurred pursuant to the Settlement Agreement as approved by the Parties and approved by the Court; (ii) any taxes owed by the Settlement Fund; (iii) any Service Awards approved by the Court; (iv) any attorneys’ fees, costs, and expenses as approved by the Court; and (v) any benefits to Settlement Class Members, pursuant to the terms and conditions of the Settlement…
Settlement Class Members may submit a claim for up to Five Thousand Dollars and No Cents ($5,000.00) per individual for documented Out-of-Pocket Losses.”
