Ripple legal director discusses possible SEC appeal outcomes
Stuart Alderoty, Ripple's (CRYPTO:XRP) legal director, recently shared his perspective on the ongoing legal battle between Ripple and the U.S. Securities and Exchange Commission (SEC).
He discussed the potential outcomes of the SEC's appeal and Ripple's defense strategies as the case moves forward.
According to Alderoty, there is doubt surrounding the likelihood of the SEC's appeal succeeding, with the Second Circuit either upholding or potentially expanding Judge Analisa Torres's decision.
Alderoty pointed out that the chances of the case being sent back for further review are slim, noting, “The SEC could argue that Judge Torres is not of ‘ordinary or average intelligence.’ That would be odd.”
Ripple’s legal strategy, if the case is remanded, will rely on its “Fair Notice” defense, questioning whether the average person could have understood if their actions were legal under the current regulations.
In his statements, Alderoty compared the SEC’s aggressive pursuit of Ripple to works like "Moby Dick" and "My Cousin Vinny," drawing attention to the SEC’s persistent stance on market regulations.
He emphasized that the initial court ruling, which declared XRP is not a security, remains valid, signaling potential positive developments for XRP’s market price.
Legal experts suggest that while the SEC has not appealed all aspects of the case, the final ruling could still be contested during the appeal process.
Ripple's upcoming launch of the RLUSD (CRYPTO:RLUSD) stablecoin is expected to be a significant step, as the company secures regulatory approvals following the recent legal decisions.
This development may further reinforce Ripple's position and contribute to the recovery of XRP’s value, according to analysts.
At the time of writing, the XRP price was $0.5487.
