SEC sets crypto as top examination priority for 2025

The U.S. Securities and Exchange Commission (SEC) has identified cryptocurrencies as a key examination focus for 2025. 

In its Oct. 21 announcement, the SEC’s Division of Examinations included crypto assets and their associated products and services, highlighting specific attention on spot Bitcoin (CRYPTO:BTC) and Ether (CRYPTO:ETH) exchange-traded products (ETPs) that launched in 2024. 

The SEC plans to scrutinise the "offer, sale, recommendation, advice, trading, and other activities involving crypto assets," focusing on risks related to blockchain and distributed ledger technology. 

“Given the volatility and activity involving the crypto asset markets, the Division will continue to monitor and, when appropriate, conduct examinations of registrants offering crypto asset-related services,” stated the SEC. 

The Division aims to assess practices around technological risks, such as the security of digital assets. 

Keith Cassidy, Acting Director of the Division of Examinations, explained that the 2025 priorities spotlight "key areas of potentially increased risks and related harm for investors." 

The statement reflects the SEC’s continued approach under current Chair Gary Gensler, who emphasised that the division’s work aims to guide participants in understanding rules, with a focus on investor protection and capital formation. 

The SEC’s priorities list is notably different from 2024’s, as it now includes spot Bitcoin and Ether ETPs following their approvals earlier this year. 

The regulatory stance may remain firm, but a change in leadership could be on the horizon. 

Current SEC Chair Gary Gensler’s term is set to expire in 2026, but with the potential of new U.S. leadership in January 2025, experts speculate on the possibility of his departure. 

Both Donald Trump and Kamala Harris have reportedly discussed new candidates for the role.
