Trump administration seeks to move tariff lawsuit to court of international trade, where chances of success are higher

US President Trump is seeking to steer the judicial challenge to his comprehensive tariff policy to the Court of International Trade (CIT) specializing in tariff disputes. Although this strategy did not achieve immediate victory in his first term, it ultimately won favorable results for him. The Trump administration is working to transfer three lawsuits filed in federal courts in Florida, Montana, and California to the Court of International Trade. Legal experts point out that bringing these current series of cases into this judicial path may benefit the government. As these cases will be appealed to the federal circuit court, which has always shown a respectful attitude towards the President's authority to impose tariffs. "The Court of International Trade has made unfavorable rulings in several cases against the government," said Warren Maruyama, former Chief Legal Counsel of the US Trade Representative's Office, "but most of these rulings have been overturned on appeal to the federal circuit court."
